VOIP Service Conditions
The following describes the terms, conditions and limitations that apply to your use of the Internet Protocol (VoIP) telephone services ("VoIP Terms") provided by The Croo Group Inc. ("Croo", "we", "us" and "our").
These VoIP Terms form part of Croo's terms of use, available at https://www.croo.io/ (as amended, restated or replaced from time to time, the "Terms of Use"). Capitalized terms in these VoIP Terms that are not defined have the meanings ascribed to them in the Terms of Use. By placing an order for any of our Services or by accessing our Services, you confirm that you accept these VoIP Terms.
These VoIP Terms contain important provisions, including provisions relating to 9-1-1 service.
1 Description
The VoIP service allows you to make or receive telephone calls over the Internet to or from the public switched telephone network. VoIP telephone calls, while similar in appearance to traditional telephone calls, have their own limitations and conditions; you acknowledge and agree that differences exist between traditional telephone service and VoIP telephone service, including the absence of traditional 911 emergency service.
Due to the nature of VoIP telephone calls, emergency calls made to 9-1-1 using VoIP service will be handled differently than those made using traditional telephone service. The following provisions describe the differences and limitations relating to 9-1-1 emergency calls, and you hereby acknowledge and understand the differences set forth below between traditional 9-1-1 service and VoIP 9-1-1 service with respect to 9-1-1 calls made using your VoIP line.
2.1Making 9-1-1 calls:
When you make a 9-1-1 emergency call, the VoIP service will attempt to automatically route your 9-1-1 call, through a third-party service provider, to the Public Safety Answering Point(PSAP) that corresponds to the address on your subscription record. However, due to the limitations of VoIP telephone services, your 9-1-1 call may be routed to a different location from where your call would be routed by traditional 9-1-1 service. For example, your call may be transferred to a third party who specializes in handling emergency calls. This call center is different from the PSAP that would answer a traditional 9-1-1 call and where your contact information is automatically displayed; therefore, you may need to provide your name, address and telephone number to the call center operator.
2.2Transmitting your contact information:
The VoIP service will attempt to automatically provide your contact information to the PSAP dispatcher or emergency operator, along with the name, address and phone number from your subscription record. However, for technical reasons, the receiving dispatcher may not be able to record your name, phone number and location. Therefore, when you make a 9-1-1 emergency call, you must immediately tell the dispatcher where you are (or the location of the emergency, if different). If you are unable to speak, the dispatcher may not know where you are if the contact information in your subscription file is not up to date.
2.3Accuracy of information:
You are responsible for providing and updating your contact information (including your name, home address and telephone number). If you do not provide your correct address, or if your contact information has recently changed or has not been updated, 9-1-1 calls may be routed to the wrong emergency call center.
2.4Interruptions:
As the dispatcher may not have your number and contact details, you should not interrupt your 9-1-1 emergency call until the dispatcher allows you to do so. If you inadvertently lose the call, call back immediately.
2.5Call set-up time:
For technical reasons, including network congestion, a 9-1-1 emergency call may produce a busy signal, or take longer to set up than a traditional 9-1-1 emergency call.
2.69-1-1 calls may not work:
For technical reasons, VoIP 9-1-1 emergency calls may not be possible, or service may be restricted, in the following situations, without limitation:
(a) A failure of service or of your service access device. If your system access device ceases to function or is not properly configured, or if your VoIP service does not function properly for any reason, including power failure, VoIP service interruption, service suspension or disconnection due to billing issues, network or Internet congestion, or network or Internet failure due to power, network or Internet failure.
(b) Configuration. You may need to reboot or reconfigure the system access device before you can use VoIP service, including 9-1-1 emergency calls.
(c) Change of location. If you install your system access device in a location other than the one indicated in your subscription details or in your subscription file with Croo.
If you are uncomfortable with the limitations of 9-1-1 emergency calls, Croo recommends that you cancel your VoIP subscription or consider an alternative to traditional 9-1-1 emergency service.
You are required to inform, and you agree to inform, any user or prospective user of your VoIP Service of the nature and limitations of 9-1-1 emergency calls made using the VoIP Service, in accordance with this Agreement.
5.1. YOU ACKNOWLEDGE THAT YOUR USE AND THE USE BY ANY USER OR POTENTIAL USER OF YOUR VOIP SERVICES WITH CROO IS SUBJECT TO THESE LIMITATIONS.
5.2. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CROO, ITS DIRECTORS, EMPLOYEES, AGENTS OR LICENSORS BE LIABLE FOR ANY LIABILITY RELATING TO OR ARISING OUT OF (AND YOU HEREBY RELEASE AND DISCHARGE CROO FROM ANY LIABILITY RELATING TO) (A) YOUR USE OR INABILITY TO USE OUR SERVICES TO MAKE 9-1-1 EMERGENCY CALLS, (B) THE ROUTING OF YOUR 9-1-1 EMERGENCY CALLS TO A DIFFERENT LOCATION THAN WOULD BE USED BY TRADITIONAL 9-1-1 SERVICE OR TO THE WRONG EMERGENCY RESPONSE LOCATION (C) ANY FAILURE TO PROVIDE ACCURATE OR COMPLETE INFORMATION REGARDING YOUR NAME, TELEPHONE NUMBER OR PHYSICAL ADDRESS TO THE 9-1-1 DISPATCHER, (D) ANY FAILURE TO CONNECT OR DISCONNECT YOUR 9-1-1 EMERGENCY CALL, (E) THE TERMINATION OR RESTRICTION OF THE FUNCTIONALITY OF VOIP 9-1-1 EMERGENCY CALLS FOR ANY REASON, INCLUDING FOR THE REASONS DESCRIBED IN SECTION 2.6 OF THESE VOIP TERMS AND CONDITIONS, OR (F) THE ACTIVITIES OF ANY THIRD PARTY PROVIDER INVOLVED IN THE PROVISION OF 9-1-1 CALLING SERVICES OR EMERGENCY RESPONSE SERVICES, INCLUDING EMERGENCY RESPONSE CENTERS, CALL CENTERS AND THIRD PARTIES ENGAGED BY THE CUSTOMER TO FACILITATE ADDRESS UPDATES.
5.3. The Customer shall defend, indemnify and hold harmless Croo and its related companies, and its directors, officers, employees, agents, shareholders, successors and assigns from and against any and all claims, losses, damages, penalties, liabilities and expenses, including reasonable legal fees and expenses, of any nature whatsoever awarded in connection with or arising out of any third party claim relating to any of the situations described in Section 5.2 of these VoIP Terms.
These VoIP Terms may be amended from time to time. Any changes will be posted on our Websites or in any application or administrative control for accessing our Services. Your continued use of our Services following any modification will mean that you accept such modification. If you do not agree to the changes, you may terminate your use of our Services. Please refer to your contract with us for further details.
